This letter is only suitable for use with MW or MWD.
Dear
We hereby give notice that regular progress of the Works has been materially
disrupted/prolonged [ delete as appropriate ] by matters for which the employer
or you as the employer's agent are responsible. In our view, such matters
exceed the situation contemplated by clause 3.6.3 of the conditions of contract.
The matters are [ describe ].
Although the contract appears to have no machinery for dealing with claims
of this nature, we are advised that we may bring an action at common law. We
believe that the matters are capable of easy resolution by the employer or by
you with proper authority. We should be content to proceed on this basis and
we should be pleased to hear whether the employer is in agreement. If the
employer is not prepared to deal with us on this basis or if we do not hear from
you by [ insert date ] we shall formulate our claim for damages at common law.
