Dear
We are entitled to an amount in respect of loss and/or expense (including
financing charges) to be added to the contract sum in accordance with
clause 4.19 of the conditions of contract. Our application for payment under
clause 4.9 is attached. Therefore in accordance with supplemental provision
paragraph 5.2 in Schedule 2, we submit our estimate of such loss and/or
expense, incurred in the period immediately preceding that for which such
application is made, which we require to be added to the contract sum. We
shall continue to submit estimates in accordance with paragraph 5.3 for so
long as we continue to incur direct loss and/or expense.
May we remind you that within 21 days of receipt of this estimate, you must
give us written notice either that you accept our estimate, or that you wish to
negotiate and in default of agreement that you wish to refer the issue as a
dispute to adjudication, or clause 4.19 will apply.
