To architect, if a change in statutory requirements after base date
This letter is not suitable for use with IC, MW, MWD or GC/Works/1
(1998).
Dear
On [ insert date ] there was a change in statutory requirements which
necessitates an alteration or modification to the Contractor's Designed
Portion [ substitute 'to the Works' when using DB ][ give details ].
We are putting the necessary amendment in hand and we will write to you
again as soon as we are in a position to value the amendment which is to be
treated as a variation [ substitute 'change' when using DB ] instruction under the
provisions of clause 2.17.2.1 [ substitute '2.15.2.1' when using ICD or DB ]ofthe
conditions of contract. [ When using DB, add: ] In our view, this is not an
instruction to be dealt with under supplemental provision 4.

Therefore, please take this letter as notice of delay under clause 2.27.1
[ substitute '2.19.1' when using ICD or '2.24.1' when using DB ] and application for
loss and/or expense under clause 4.23 [ substitute '4.17' when using ICD or '4.19'
when using DB ].
