The certification shall be carried out through:
(a) random checks based on a risk analysis;
(b) sampling; or
(c) systematically.

In the case of random checks, Art 63(3) provides that they shall be based on a
control plan pre-established by the authority(-ies) covering different stages of
production of the product. The control plan shall be known by the operators.
Member States shall select randomly the minimum number of operators to be
subjected to this check.

In the case of sampling, Art 63(3) of Regulation 607/2009 provides that
Member States shall ensure that by their number, nature and frequency
controls, they are representative of the whole of their territory and correspond
to the volume of wine-sector products marketed or held with a view to their
marketing.

Random checks may be combined with sampling.
6. Excluded wine grape varieties
4.341
Article 60(2) of the Wine Regulation provides that without prejudice to Art
42(3), as regards the use of particulars referred to in Art 60(1)(a) and (b) for
wines without a PDO or GI:
(b) Member States may, on the basis of non-discriminatory and objective criteria and
with due regard to loyal competition, for wine produced from wine grape varieties
on their territory, draw-up lists of excluded wine grape varieties, in particular if:
(i)
there is a risk of confusion of consumers as to the true origin of the wine due
to the fact that the given wine grape variety forms an integral part of an
existing protected designation of origin or geographical indication;
(ii)
the relevant controls would not be cost-effective due to the fact that the given
wine grape variety represents a very small part of the Member State vineyard.
7. Mixtures of wines
4.342
Article 60(2)(c) of the Wine Regulation provides that, without prejudice to Art
42(3) as regards the use of particulars referred to in Art 60(1)(a) and (b) of the
Wine Regulation for wines without a PDO or GI, 'mixtures of wines from
different Member States shall not give rise to labelling of the wine grape variety
or varieties unless the Member States concerned agree otherwise and ensure the
feasibility of the relevant certification, approval and control procedures'.
