Article 39(2) requires that such control bodies shall be accredited in accordance
with European Standard EN 45011 or ISO/IEC Guide 65 (General require-
ments for bodies operating product certification systems).
Article 39(3) provides that the accreditation referred to in Art 39(2) of this
Article may only be performed by:

(a) a national accreditation body in the Union in accordance with the provisions of
Regulation (EC) No 765/2008; or
(b) an accreditation body outside the Union that is a signatory of a multilateral
recognition arrangement under the auspices of the International Accreditation
Forum.
7. Planning and reporting of control activities
Article 40(1) requires that Member States shall ensure that activities for the
control of obligations under this Chapter are specifically included in a separate
section within the multi-annual national control plans in accordance with Arts
41, 42 and 43 of Regulation (EC) No 882/2004.

Article 40(2) requires that the annual reports concerning the control of the
obligations established by this Regulation shall include a separate section
comprising the information laid down in Art 44 of Regulation (EC) No
882/2004.

8. Role of groups
Recital (29) to the Regulation maintains that protection should be granted to
names included in the register with the aim of ensuring that they are used fairly
and in order to prevent practices liable to mislead consumers. In addition, the
means of ensuring that GIs and designations of origin are protected should be
clarified, particularly as regards the role of producer groups and competent
authorities of Member States.

Recital (57) refers to the role of groups which play an essential role in the
application process for the registration of names of designations of origin and
GIs and TSGs, as well as in the amendment of specifications and cancellation
requests. Recital (57) also mentions the role of groups in: the surveillance of the
enforcement of the protection of the registered names; the compliance of
production with the product specification: the promotion and improving the
value of the registered names and effectiveness of the quality schemes; and
monitoring the position of the products on the market.
