The costs of such verification of compliance with the specifications may be
borne by the operators that are subject to those controls. The Member States
may also contribute to these costs.

Article 37(2) provides that in respect of designations of origin, GIs and TSGs
that designate products originating in a third country, the verification of
compliance with the specifications before placing the product on the market
shall be carried out by:
(a) one or more of the public authorities designated by the third country; and/or
(b) one or more of the product certification bodies.

Article 37(3) provides that Member States shall make public the name and
address of the authorities and bodies referred to Art 37(1) of this Article, and
update that information periodically.

The Commission shall make public the name and address of the authorities and
bodies referred to in Art 37(2) of this Article and update that information
periodically.

Article 37(4) provides that the Commission may adopt implementing acts,
without applying the procedure referred to in Art 57(2), defining the means by
which the name and address of product certification bodies referred to in Art
37(1) and (2) of this Article shall be made public.
5. Surveillance of the use of the name in the market place

Article 38 requires that Member States shall inform the Commission of the
names and addresses of the competent authorities referred to in Art 36. The
Commission shall make public the names and addresses of those authorities.

Member States shall carry out checks, based on a risk analysis, to ensure
compliance with the requirements of this Regulation and, in the event of
breaches Member States shall take all necessary measures.
6. Delegation by competent authorities to control bodies
3.311
Article 39(1) provides that competent authorities may delegate, in accordance
with Art 5 of Regulation (EC) No 882/2004, specific tasks related to official
controls of the quality schemes to one or more control bodies.
