D. SCOPE
1. Agricultural products intended for human consumption
Recital (15) to the Regulation states that its scope should be limited to the
agricultural products intended for human consumption listed in Annex I to the
Treaty and to a list of products outside the scope of that Annex that are closely
linked to agricultural production or to the rural economy. This is sought to be
achieved by Art 2(1) which provides that the Regulation covers agricultural
products intended for human consumption listed in Annex I to the Treaty and
other agricultural products and foodstuffs listed in Annex I to this Regu-
lation. 28

Recital (17) proposes that the scope for designations of origin and GIs should
be limited to products for which an intrinsic link exists between product or
foodstuff characteristics and geographical origin. It maintains that the inclusion
in the current scheme of only certain types of chocolate as confectionery
products is an anomaly that should be corrected.

Annex I under the heading 'Designations of Origin and Geographical indica-
tions' lists beer, chocolate and derived products, bread, pastry, cakes, confection-
ery, biscuits and other baker's wares, beverages made from plant extracts, pasta,
salt, mustard paste, cochineal. Under the heading 'Traditional specialities
guaranteed' Annex II lists prepared meals, beer, chocolate and derived products,
bread, pastry, cakes, confectionery, biscuits and other baker's wares, beverages
made from plant extracts, pasta, salt.

Annex I of the EU Treaty includes basic foods intended for human consump-
tion such as meat, dairy and fish products, honey, fruits and vegetables. The
Regulation does not currently include condiments and sauces, soups, ice cream,
sorbet and products containing cocoa. Mention has been made of the unregis-
trability under the previous Regulation of the fish sauce 'Phu Quoc', one of few
GIs registered in Vietnam (Evans, 2010 at 660). This would seem to remain the
case.

Under the Regulation, the coverage of agricultural products is broader than
applications to foods, For example listed in Annex I under the heading

Article 2(1) envisages that in order to 'take into account international commitments or new production
methods or material', the Commission shall be empowered to adopt delegated acts, in accordance with Art. 56,
supplementing the list of products set out in Annex I to this Regulation. Such products shall be closely linked to
agricultural products or to the rural economy.
