Contractor responsible for the design as well as completing the works.
The contract may be based on a concept provided by the employers advisors .
Alternatively the contractor may be responsible for providing and completing the
design from the outset (either through the contractors in-house team or engaging
design specialists.)
Often a “novation agreement” is put in place so that the architect or designer who
initially worked on the scheme with the employer continues to complete the
design under the responsibility of the main contractor.

This contract follows the concept of the design and build arrangement, applied to
the larger type project.
This may be based on an “Employer led design and build arrangement“ or a
“Contractor led design and build relationship”.
Separate relationship diagrams are illustrated for both these situations in the
notes on Design and Build.
4.4 JCT design and build contract - 2011
The design and build contract is designed for construction projects where the con-
tractor carries out both the design and construction work.
The scale of design work needed to be carried out by the contractor can vary
greatly on design and build projects.
Sometimes the contractor will complete the design based on the concept provided
by the employer's advisors. Novation of the clients design team is common prac-
tice and this arrangement can be expressed as “Client Led Design and Build”.
Other arrangements may call for the contractor to be responsible for producing
and completing the design right from the outset. The arrangement is often expressed
as “Contractor Led Design and Build”. Refer to relationship diagrams for the above
situations.
Adequate time is needed to allow detailing of the employers requirements to
ensure that design requirements are fully met.
The employer will normally use a clients representative to administer the contract
(project manager etc.). Both the client and contractor follow procedures contained
in the PIBA Plan of Work in relation to the stages in the design and construction
process.
A number of bar chart displays based on the Plan of Work will be included to clarify
the sequence of events during the design / tender and construction process. These
bar chart displays will be included in a separate section.
