Trade Contract Sum Valuation of variations and provisional sum work
4.4
.1 Where Article 2.1 applies then:
— all Variations required by an instruction of the ConstructionManager to
which clause 3.20 refers or subsequently sanctioned by him in writing,
and
— all work which under the Conditions is to be treated as if it were a
variation required by an instruction of the Construction Manager to
which clause 3.20 refers, and
— all work executed by the Trade Contractor in accordance with instruc-
tions by the Construction Manager to which clause 3.21 refers as to the
expenditure of provisional sums which are included in the Trade
Contract Documents, and
— all work executed by the Trade Contractor for which an Approximate
Quantity has been included in any bills of quantities which are included
in the Trade Contract Documents shall unless otherwise agreed by the
construction manager and the Trade Contractor be valued (called 'the
Valuation'), under Alternative A in clause 4.4.2 or, if Alternative A is
not implemented by the Trade Contractor, or if implemented, to the
extent that the Price Statement or amended Price Statement is not
accepted, under Alternative B in clause 4.4.2. Clause 4.4.1 shall not
apply in respect of a Variation for which the Construction Manager
has issued a confirmed acceptance of a 3AQuotation or is a Variation to
which clause 3A.8 applies.

.2 Alternative A: Trade Contractor's Price Statement
Paragraph
4.4 A1 Without prejudice to his obligation to comply with any instruction or to
execute any work to which clause 4.4.1 refers, the Trade Contractor may
within 17 days from receipt of the instruction or, if later, from receipt of
sufficient information to enable the Trade Contractor to prepare his
Price Statement, submit to the Construction Manager his price ('Price
Statement') for such compliance or for such work.
The Price Statement shall state the Trade Contractor's price for the work
which shall be based on the provisions of clause 4.5 and clause 4.6
( Valuation rules ) and may also separately attach the Trade Contractor's
requirements for:

any amount to be paid in lieu of any ascertainment under
clause 4.21 of direct loss and/or expense not included in any
accepted 3A Quotation or in any previous ascertainment under
clause 4.21;

any adjustment to the time for the completion of the Works to the
extent that such adjustment is not included in any revision of the
period or periods for completion that has been made by the Con-
struction Manager under clause 2.3 or in his confirmed acceptance
of any 3A Quotation. (See paragraph A7.)
4.4 A2 Within 24 days of receipt of a Price Statement the Construction Manager
shall notify the Trade Contractor in writing
