By copy of this letter to the architect, we give notice of delay under
clause 2.27.1 [ substitute '2.19.1' when using IC or ICD or 2.24.1' when using DB ]
involving a Relevant Event under clause 2.29.6 [ substitute '2.20.6' when using IC
or ICD or '2.26.5' when using DB ] and make application for loss and/or expense
under clause 4.23 [ substitute '4.17' when using IC or ICD or '4.19' when using DB ]
involving a Relevant Matter under clause 4.24.5 [ substitute '4.18.5' when using
IC or ICD or '4.20.5' when using DB ]. However, such notice and application is
without prejudice to any other rights and remedies including (but without
limitation) the right to treat the failure to give possession as a serious breach of
contract entitling us to damages and, if prolonged, to treat it as a repudiation
of the contract on your part.
Naturally, we hope that your difficulties will be resolved and we should
welcome a meeting with you to discuss the prospects of taking possession
of the site. To that end we are generally available on [ insert list of dates ] and
