Although we undertook to execute a novation agreement, we did not bind
ourselves to execute any particular agreement which you might chose to
present to us. We have not had the opportunity to see this agreement before
and, therefore, we have requested legal advice on the content. We will let you
know the result in due course. In the meantime any delay in appointing the
architect [ or substitute the name of the consultant ] will delay the start of the
Works on site and we shall expect an appropriate extension of the contract
period and reimbursement of our direct loss and/or expense, alternatively,
damages at common law.

do so now. Our intention is to enter into a completely separate agreement with
the architect [ or substitute the name of the consultant ].
