Dear
We tendered for the above work on the [ insert date ] in the sum of [ insert
amount ] and the employer accepted our tender unequivocally by letter dated
the [ insert date ]. A binding contract exists between the employer and ourselves
in terms incorporating, among other things, the provisions of [ insert the full
title of the form of contract ] which provides for certification of monies due to us.
Although we have difficulty in understanding why you have not yet prepared
the formal contract documents for signature/completion as a deed [ delete as
appropriate ], the completion of such formal contract documents will simply
reflect the respective rights and obligations of the parties as already agreed
and about which there is no doubt.
We, therefore, require you to issue your certificate in accordance with
clause 4.9 [ substitute '4.8' when using IC or ICD, or '4.3' when using MW or
MWD, or '50' when using GC/Works/1 (1998) ] of the conditions of contract
If such certificate is not in our hands by [ insert date ] we will take immediate
legal action against the employer for the breach.
