Letter 239
To sub-contractor, if no person-in-charge
This letter is not suitable for use with GC/Works/SC.
By fax and post
Dear
At the time of writing there is no person-in-charge of your sub-contract work.
This is in serious breach of your obligation under clause 3.8 [ substitute '3.7'
when using ICSub/NAM/SC, ICSub/C or ICSub/D/C ] to ensure that, at all
times during the execution of such work, you have on site a competent
person-in-charge. Among other things, it is essential that you have
someone on site to receive our directions and to organise your work.
[ If appropriate, add: ]
Currently, you are not proceeding regularly and diligently with your work
which is not being properly executed.
[ Then continue: ]
Clearly, this is having a bad effect on the progress of the main contract Works.
This situation cannot be allowed to continue and if you do not remedy this
major breach by commencement of work on site tomorrow, we shall have no
alternative but to prevent your operatives from working on the site until you
appoint a person-in-charge and notify us of the name. You are aware that any
delay in your work is certain to cause us damages, loss and expense and we
shall recover all such damages from you.
Yours faithfully
