To architect, if ascertainment delayed (a)
This letter is only suitable for use with SBC.
Dear
We refer to our notice of the [ insert date ] submitted under the provisions of
clause 4.23 of the conditions of contract and our letters of the [ insert dates ]
enclosing the further information you required in order to form an opinion
and carry out ascertainment of the amount of loss and/or expense.
[ Insert number ] weeks have elapsed since we last submitted such information
to you and, during that period, neither you nor the quantity surveyor have
requested further information or details. Clause 4.4 imposes a clear duty on
you to certify sums ascertained in whole or in part in the next interim
certificate following ascertainment. Clause 4.23 states that 'as soon as' you
are of the opinion that the Works are affected, you will 'from time to time
thereafter' ascertain the amount of loss and/or expense. A similar provision is
contained in clause 4.25. As soon as you have formed your opinion, you must
begin the process of ascertainment. As soon as any sum has been ascertained,
you must include the amount in the next interim certificate. Please inform us
by [ insert date ] the amount which you have ascertained and intend to include
in the next certificate.
