Letter 161
To architect, if unreasonably requesting further information in order
to grant an extension of time
Dear
Thank you for your letter of the [ insert date ] requesting further information in
order to enable you to grant an extension of time.
We submitted notice of delay [ substitute 'request for extension of time' when using
GC/Works/1 (1998) ], as required by the contract, on [ insert date ]. We submitted
full particulars including estimate of the effect of the delay on completion date
on [ insert date or dates or substitute 'at the same time' if appropriate ]. We believe
that you had all the information necessary to enable you to make a fair and
reasonable extension of time by [ insert date ]. It is, of course, very much in our
interests to supply you with full information as quickly as possible; this we
have done.
It is our view that your latest request for information is nothing but an attempt
to postpone the granting of an extension. We, therefore, formally call upon you
to carry out your duty under clause 2.28.1 [ substitute '2.19.1' when using IC or
ICD, '2.7' when using MW, '2.8' when using MWD or '36(1)' when using
GC/Works/1 (1998) ].
Yours faithfully
