In accordance with clause 36(1) we notify you that it is apparent that the
Works will not be complete by the date for completion. We are unable to
estimate the total delay at this stage, but when it is over, we will submit full
details immediately. You may be assured that we are using our best
endeavours to prevent delays and to minimise unavoidable delays.
The regular progress of the Works is likely to be materially disrupted and
prolonged due to the above circumstances. In consequence, we will properly
and directly incur expense in performing the contract which we would not
otherwise have incurred and which is beyond that otherwise provided for in
or reasonably contemplated by the contract. We expect to be entitled to an
increase in the contract sum under clause 43.
