To architect, if issuing instruction for removal of defective work
This letter is only suitable for use with SBC.
Dear
We are in receipt of your instruction number [ insert number ] dated [ insert date ]
instructing us to remove from site work which you state is not in accordance
with the contract. You specify the work as [ repeat the architect's description ].
Our records show that the work in question was executed on [ insert date or
dates ], some [ insert time period ] ago. The work was inherently a matter for the
architect's satisfaction under clause 2.3. We draw your attention to clause 3.20
of the conditions of contract which stipulates that you must express any
dissatisfaction with such work within a reasonable time from its execution.
It is clear that, in breach of contract, you have not so expressed such
dissatisfaction. We are now entitled to payment for complying with your
instruction and we should be pleased to have your agreement by return.
