To architect, if numerous 'specialist' clerks of works visiting site
This letter is not suitable for use with DB, MW or MWD.
Dear
Clause 3.4 [ substitute '3.3' when using IC or ICD or '4(2)' when using GC/Works/1
(1998) ] of the conditions of contract permits the employer to appoint a clerk of
works. Your letter of the [ insert date ] informed us that the clerk of works would
be [ insert name ]. During the past two weeks a number of persons have
presented themselves at our site office purporting to be 'specialist clerks of
works' [ or substitute the actual title ] and demanding access to the Works.
These persons are neither known to us nor included in the contract and,
therefore, we have exercised our right to exclude them from the Works.
We already permit inspections by those consultants introduced at the project
start meeting of the [ insert date ] even though the contract is silent as to their
existence, because we desire to extend all reasonable co-operation. To allow
'specialist clerks of works' free access would not, in our view, be reasonable. If
you require us to grant them such access, please so inform us in writing, but
note that, in such circumstances, we consider that our progress would be
hindered and we will take appropriate legal advice in regard to our rights
and remedies.
