Letter 97
To architect, regarding instructions issued on site by the clerk of works
This letter is only suitable for use with GC/Works/1 (1998).
Dear
The clerk of works has issued instruction number [ insert number ] dated [ insert
date ] on site, a copy of which is enclosed.
Clause 4(2) of the conditions of contract provides that the clerk of works may
issue only instructions under clause 31 unless you expressly delegate other
powers to the clerk of works in writing and notify us under the provisions of
clause 4(4).
The enclosed instruction does not fall under the provisions of clause 31 and
we have not yet received a clause 4(4) notice from you. Our agent on site has
strict instructions from us that instructions of the clerk of works are not to
be executed unless expressly empowered by the contract. If you wish the
instruction to be carried out, please let us have your confirmation without
delay or, alternatively, a notice under clause 4(4) that the clerk of works has
power to issue any instructions which the contract empowers you to issue.
