Letter 96
To architect, regarding directions issued on site by the clerk of works
This letter is not suitable for use with GC/Works/1 (1998).
Dear
The clerk of works has issued direction number [ insert number ] dated [ insert
date ] on site, a copy of which is enclosed.
Such directions have, of course, no contractual effect [ insert 'unless you confirm
them within 2 working days of issue' when using SBC ]. Clearly, the directions of
the clerk of works issued in relation to the correction of defective work can be
very helpful. We are anxious to avoid misunderstandings on site and in this
spirit we suggest that the clerk of works should issue no further directions,
other than those relating to defective work. All other matters can be referred
directly to you by telephone and, at your discretion, a proper architect's
instruction can be issued.
In our view, the above system would remove a good deal of the uncertainty
which must result from the present state of affairs. We look forward to hearing
your comments.
Yours faithfully
