If you've been looking for a common thread, you may have noticed that the
law assumes that the work would not have been made without the larger project, and
that the work would not necessarily stand on its own. On the other hand, both par-
ties have to agree in writing that the project should be considered a “work made for
hire.” Any item that both parties put their names to that calls it such is considered a
binding contract. The phrase has, therefore, been known to be tucked into a work
contract and printed on the back of payment checks.
