based on fair use within four criteria:
1.
the purpose and character of the use including whether its commercial or
nonprofit,
2.
the nature of the copyrighted work,
3.
the amount and substantiality of the portion used in relation to the
copyrighted work as a whole, and
4.
the effect of the use upon the potential market for or value of the
copyrighted work.
Kimball also states that it is difficult to find fair use of images and graphics.
However, one good rule to follow that is cited by Kimball is that in most cases
if the images used for educational purposes, which means that it is engaged in
learning rather than selling, it is deemed fairly used.
Metaphors and Image Maps
Metaphor can be a productive conceptual tool for visual communication. Use
of metaphors in visual Web design is quite popular, definitely on home pages.
When we use the term metaphor and image map we are referring to image
based navigation systems employed in Web pages.
Metaphors provide theme based image maps with contextual value. Metaphors
must have meaning. The image map/metaphor will guide the user action. For this
to happen, the user must be familiar with the metaphor (Kristoff & Satran,
1995).
Identity
Identity is a crucial element to developing a strong visual relationship with the
user. Personal touches whether business worthy (a department logo) or not
(your hiking photo), should be part of your sites overall visual plan. Don't go
