In 2005, DB was prohibited or existed as a very limited option in many states; how-
ever, during that year, a record number of bills to expand DB authority passed in state
legislatures across the country. Since 2005, the number of bills introduced to allow DB
or to remove the limitations to DB has dropped steadily; however, the DB bills that are
introduced to state legislatures typically pass (Figure 4-3). In 2005, 250 bills were intro-
duced, and 82 of them passed. This equates to a 33 percent passage rate (Figure 4-4). In
2009, the number of bills introduced was only 160, but 100, or 62 percent, of those bills
became law (Thomas 2010a).
