The. lesson. here. is. that. with. well-designed. policies. and.
procedures.that.are.published.and.followed,.a.company.can.
protect. itself. from. liability. and. possibly. a. loss. of. important.
evidence.in.a.trial.
Another.lesson.comes.from.the.fact.that.the.courts.said.
that. had. the. defendant. done. anything. to. protect. that. data,.
such. as. encrypting. it,. or. purposefully. deleting. it. he. might.
have. had. an. argument. to. retain. his. privilege. because. he.
had. taken. steps. to. protect. the. privacy. of. the. information..
However,.lacking.those.precautions,.he.had.no.good.reason.
to. expect. privacy. of. the. data. stored. on. a. computer. owned.
by. the. company. he. was. working. for,. especially. after. being.
explicitly. notiied. and. implicitly. agreeing. to. a. lack. of. that.
