munications.in.such.a.way.as.to.be.able.to.prove.to.a.court.or.
to.the.opposing.party.that.information.is.privileged.and.not.
available.for.discovery.or.production.
To.you.as.an.individual,.this.means.that.if.you.think.you.
are.communicating.to.one.of.the.entities.noted.in.the.deini-
tion. above. on. a. conidential. basis,. you. should. look. for. and.
require.that.they.are.maintaining.the.proper.management.of.
those.conversations.
For. instance,. in. an. e-mail. correspondence. with. your.
attorney,.you.should.see.something.in.the.subject.line.saying.
“Attorney-Client.Privileged.”.If.you.are.ever.concerned.about.
a.professional's.management.of.your.conidential.information,.
you.should.ask.and.require.a.suficient.answer.and.explana-
tion.of.how.they.are.managing.privileged.information.
In.most.all.court.cases.where.there.is.any.question.of.privi-
lege,.an.attorney.is.required.to.keep.and.produce.a.privilege.
log. that. documents. privileged. communications. and. proves.
that.those.communications.should.be.privileged.and.kept.out.
of.evidence..That.privilege.can.be.lost,.however,.if.data.are.
inadvertently.produced.through.the.error.or.oversight.of.an.
attorney.or.their.staff..This.has.happened.in.some.cases,.and.
