• in the industrial sector the lack of internal knowledge and the lack of appeal for
investments, which have a long-term payback.
In order to improve the level of energy efficiency the SEN focuses on:
• a longer applicability of the tax deduction/credit system;
• other forms of public support (by way of example in the public sector the so
called ''conto termico'' and the usage of the EU funds);
• a set of rules, which should facilitate better energy efficiency (inter alia the rules
set forth by directive No. 2002/91/CE and directive No. 2010/31/EU for new
buildings, the energy certification/audit, inspection on the plants, the criteria for
qualification of energy efficiency experts etc.);
• the system of the certificati bianchi (''white certificates'') for interventions in
the industrial sector.
Furthermore, according to the SEN, actions for improvements made on energy
efficient buildings open the door to a reassessment of the planning and manage-
ment of the cities taking into consideration that 70 % of the energy is consumed in
the cities.
The law ascribes a leading role in the achievement of energy efficiency to
public entities (article 12 and following of legislative decree No. 115/2008 2 ).
The public bodies:
(1) must identify a ''responsibility for achieving the goals of energy efficiency'';
(2) in relation to the public buildings,
• shall use financial instruments for energy savings (in other words they must
use any financial means made available to both public and private bodies in
order to cover wholly or partially the costs of the projects) in case of reali-
zation of requalification interventions;
• must carry on energy audits in case of a heating systems restructuring or in
case of a restructuring of the building and they must obtain the energy
certifications for buildings according to the thresholds of the floors;
• in case of new buildings or restructuring must apply the rules on energy
performance set forth by legislative decree No. 192/2005 (which implements
Directive 2002/91/EC on the energy performance of buildings) and as further
amended by the law decree No. 63/2013 (implementing Directive No. 31/
2010/EU) and must pursue the objective of ''quasi zero-energy buildings''
(please see article 4-bis of legislative decree No. 192/2005), promoting the
recourse to ESCO schemes, the recourse to public-private partnership and
financing with third parties (the so called ''third-party financing contracts''),
exploiting the funds of the Cassa conguaglio per il settore elettrico (please
see art. 4-ter of legislative decree No. 192/2005 and article 22 of legislative
decree No. 28/2011). Again, in order to facilitate the funding of these
