Article 11(2) of Commission Implementing Regulation (EU) No 716/2013
provides that if the application is not complete the Commission shall invite the
applicant to remedy the deficiency within a period of two months. If the
deficiency is not remedied within that time limit, the Commission shall reject
the application as inadmissible.

(j) Scrutiny by the Commission
Article 17(5) of the Spirits Regulation provides that the Commission shall
verify, within 12 months of the date of submission of the application referred to
in Art 17(1), whether that application complies with this Regulation.
5.82
Article 17(6) of the Spirits Regulation provides that if the Commission
concludes that the application referred to in para 1 complies with this Regu-
lation, the main specifications of the technical file referred to in Art 17(4) shall
be published in the Official Journal of the European Union , C Series.

(k) Scrutiny of the conditions of validity
Article 12(1) of Commission Implementing Regulation (EU) No 716/2013
provides that if a GI does not comply with Art 15 of the Spirits Regulation or if
the application for registration does not meet the requirements laid down in Art
17 of the Spirits Regulation, the Commission shall set a time period for its
amendment or withdrawal or for the submission of comments by the Member
State, the third country authority or the private entity from the third country in
question.
5.84
Article 12(2) provides that if the deficiencies are not remedied by the Member
State, the third country authority or the private entity from the third country in
question within the time period referred to in Art 12(1) of Commission
Implementing Regulation (EU) No 716/2013, the Commission shall reject the
application.

(l) Correcting deficiencies in the technical file
Article 9(1) of Commission Implementing Regulation (EU) No 716/2013
provides that if the technical file for an established GI, submitted pursuant to

Art 6 provides that the application for registration of a GI in Annex III to Regulation (EC) No 110/2008 shall
be submitted to the Commission and consist of:
(a)
the application form, according to the model set out in Annex I to this Regulation;
(b)
the technical file, according to the model set out in Annex II to this Regulation;
(c)
the main specifications of the technical file referred to in point (b).
