the use of European GIs and other geographical names listed in Schedule 2 to
the Agreement.
Article 8 of the Agreement provided a number of transitional periods after
which Australia had to discontinue its use of European names designated.
These were: (a) transitional period ending on 31 December 1993: Beaujolais,
Cava, Frascati, Sancerre, Saint-Emilion/St. Emilion, Vinho Verde/Vino Verde,
White Bordeaux; (b) transitional period ending on 31 December 1997: Chi-
anti, Frontignan, Hock, Madeira and Malaga.

Article 9 of the Agreement provided for the negotiation by 31 December 1997
of transitional periods for: Burgundy, Chablis, Champagne, Claret, Graves,
Marsala, Moselle, Port, Sauternes, Sherry and White Burgundy.

A transitional period for 'Beaujolais' was to be subject to an agreement between
the Australian producers and the competent French authorities representing
the producers of 'Beaujolais'.

The Wine Agreement and the 1993 amendments to the Australian Wine and
Brandy Corporation Act 1980 sought to preserve existing commercial agree-
ments. Thus, for example, although 'Bereich Kaiserstuhl', a sub-region of
Baden, was listed as a Federal Republic of Germany Geographical Indication in
Annex II of the Agreement, the provisions of the commercial agreement
reached between Zentralkellerei Badisher Winzergenossenschaften e.G. and
Barossa Co-operative Winery Limited regarding the use of Kaiser Stuhl
continued to apply. 85

It was subsequently decided that the matters still to be negotiated would be
included in an updated wine agreement and on 23 October 2000 the Council of
Europe authorised the European Commission to negotiate a new agreement
and a new Agreement between the European Community and Australia on
Trade in Wine was initialled by both parties on 5 June 2007 and signed in
Brussels on 1 December 2008, coming into force on 1 September 2010. 86

The Agreement inserted the phase-out dates, which were not agreed in the
1994 Agreement, for some GIs. Thus a 12-month termination date was agreed
to prohibit use of: Burgundy, Chablis, Champagne, Graves, Manzanilla,
