Q. ENFORCEMENT

Article 62 provides that the competent authorities of the Member States shall
take measures to ensure that a product referred to in Art 59(1) not labelled in
conformity with this Chapter is not placed on, or is withdrawn from, the
market.

STATES RELATING TO LABELLING AND PRESENTATION

Article 70(1) of Commission Regulation (EC) No 607/2009 provides that for
wines with PDO or GI produced on their territory, the particulars referred to in
Arts 61, 62 and 64-67 may be rendered compulsory, prohibited or limited as
regards their use by introducing conditions stricter than those laid down in this
Chapter through the corresponding product specifications of those wines.

Article 70(2) of Commission Regulation (EC) No 607/2009 provides that as
regards wines without PDO or GI produced on their territory, Member States
may render compulsory the particulars referred to in Arts 64 and 66.
4.353
Article 70(3) of Commission Regulation (EC) No 607/2009 provides that for
control purposes, Member States may decide to define and regulate other
particulars than those listed in Arts 59(1) and 60(1) of the Wine Regulation for
wines produced in their territories.

Article 70(4) of Commission Regulation (EC) No 607/2009 provides that for
control purposes, Member States may decide to render applicable Arts 58, 59
and 60 of Regulation (EC) No 479/2008 for wines bottled in their territories
but not marketed or exported yet.
