L. TRADITIONAL TERMS
1. Definition

Article 54 (2) of the Wine Regulation provides that 'traditional terms' 47 shall be
recognised, defined and protected in accordance with the procedure referred to
in Art 113(1) (under Art 195(2) of Regulation (EC) No 1234/2007). 48

The traditional specific terms listed in Art 29 of Regulation (EC) No 753/2002
such as (Belgium), 'gecontroleerde oorsprongsbenaming' 'appellation d'origine
contrôlée'; (Germany) 'Qualitätswein garantierten Ursprungs'; (Spain)
'Denominación de origen', 'Denominación de origen calificada'; (France)
'appellation d'origine contrôlée', 'appellation contrôlée'; (Italy) 'Denominazione
di origine controllata', 'Denominazione di origine controllata e garantita', 'vino
dolce natural'; (Portugal) 'Denominação de origem', 'Denominação de origem
controlada', 'Indicação de proveniência regulamentada', 'vinho generoso', 'vinho
dolce natural'; (UK) 'English vineyard quality wine psr' and 'Welsh vineyard
quality wine psr' are reserved by particular Member States. These traditional
terms could be only used as specified by the Member States reserving these
terms.
2. Production
4.200
Article 55(1) of the Wine Regulation provides that a protected traditional term
may only be used for a product which has been produced in conformity with the
definition referred to in Art 54(2).
4.201
Article 55(1) of the Wine Regulation provides that traditional terms shall be
protected against unlawful use and that Member States shall take the steps
necessary to stop the unlawful use of protected traditional terms.
4.202
A comprehensive regime for the protection of traditional terms is detailed in
Chapter III of Commission Regulation (EC) No 607/2009. Recital (12) to that

Art 54(1) defines 'traditional term' as 'a term traditionally used in Member States for products referred to in
Article 33(1) to designate:
(a) that the product has a protected designation of origin or geographical indication under Community or
Member State law;
(b) the production or ageing method or the quality, colour, type of place, or a particular event linked to the
history, of the product with a protected designation of origin or geographical indication.'
