Annex VII(A)(2)(c) to Regulation 1493/1999 provides that the sales descrip-
tion of quality wines psr must consist of:
+ the name of the production area,
+ the specific words indicating the particular quality such as 'quality wine
produced in a specified region' or 'quality wine psr', 'quality liqueur wine
produced in a specified region' or 'quality liqueur wine psr', 'quality
semi-sparkling wine produced in a specified region' or 'quality semi-
sparkling wine psr';
+ traditional specific particulars regulated by Art 29 of Regulation 753/
2002.

By way of derogation from the compulsory list of sales description indicated in
Annex VII(A)(2)(c) to Regulation 1493/1999 and according to Art 30 of
Regulation 753/2002, wines carrying one of the following specified regional
names under the applicable EC and national provisions may be marketed using
certain names only:
(a) Greece: '

(b) Spain: 'Cava', 'Jerez', 'Xérès' or 'Sherry', 'Manzanilla';
(c) France: 'Champagne';
(d) Italy: 'Asti', 'Marsala', 'Franciacorta';
(e) Portugal: 'Madeira' or 'Madère', 'Porto' or 'Port';

Provisions applying to third country wines marketed in the EC are also
included in the Regulation. In the context of third country wines, Regulation
752/2002 provides for national treatment. This means that third country wines
with GIs are treated the same as EC wines with GIs. In terms of the use of GIs,
there must be full compliance with the TRIPS obligations. For WTO Mem-
bers, GIs may be used if they meet the definition provided in the TRIPS
Agreement. Also, the use of homonymous GIs is permitted in accordance with
the TRIPS Agreement commitments.
4.192
Article 51(2) of the Wine Regulation requires Members to transmit to the
Commission in respect of existing protected wine names referred to in Art
51(1):
(a)
the technical files as provided for in Art 35(1);
(b)
the national decisions of approval.
