9. Basis of the Commission's decision on cancellation

Article 23(3) of Commission Regulation (EC) No 607/2009 provides that any
decision to cancel the designation of origin or GI concerned shall be taken by
the Commission on the basis of the evidence available to it. It shall consider
whether compliance with the product specification for a wine sector product
covered by a PDO or GI is no longer possible or can no longer be guaranteed,
particularly if the conditions laid down in Art 35 of the Wine Regulation are no
longer fulfilled or may no longer be fulfilled in the near future.

Such decision on cancellation shall be notified to the author of the request for
cancellation and to the Member State or the third country authorities or the
applicant established in the third country in question.
10. Multiple requests for cancellation
4.173
Article 23(4) of Commission Regulation (EC) No 607/2009 provides that in
the event of multiple requests for cancellation, following a preliminary examin-
ation of one or more such requests for cancellation, it may not be possible to
accept the continuation of protection of a designation or origin or GI, in which
case the Commission may suspend the other cancellation procedures. In this
case the Commission shall inform the other authors of the requests for
cancellation of any decision affecting them which was taken in the course of the
procedure.

Where a PDO or GI is cancelled, cancellation procedures which have been
suspended shall be deemed to be closed and the authors of the request for
cancellation concerned shall be duly informed.
11. Deletion from the Register
4.175
Article 23(5) of Commission Regulation (EC) No 607/2009 provides that
when a cancellation takes effect, the Commission shall delete the name from
the Register.
J. CONVERSION OF A PDO INTO A PGI
4.176
Article 28(1) of Commission Regulation (EC) No 607/2009 provides that a
Member State or third country authority or the applicant established in the
third country in question may request the conversion of a PDO into a PGI if
