3. Application for protection relating to a geographical area in a third
country

Article 36(1) provides that where the application for protection concerns a
geographical area in a third country, it shall contain in addition to the elements
provided for in Art 35 proof that the name in question is protected in its
country of origin.

Article 36(2) requires the application to be sent to the Commission, either
directly from the applicant or via the authorities of the third country concerned.
Article 36(3) requires the application for protection to be filed in one of the
official languages of the Community or accompanied by a certified translation
into one of those languages.
(a) Applicants
Article 37(1) provides that 'any interested group of producers, or in exceptional
cases a single producer, may apply for the protection of a designation of origin
or geographical indication' and that other interested parties may participate in
the application.

Commission Regulation (EC) No 607/2009 of 14 July 2009 provides in Art
2(1) that a single producer may be an applicant within the meaning of Art 37(1)
if it is shown that:
(a) the person in question is the only producer in the demarcated geographical area;
and
(b) where the relevant demarcated geographical area is surrounded by areas with
designations of origin or GIs, this relevant area possesses features which are
substantially different from those of the surrounding demarcated areas or charac-
teristics of the product differ from those of the products obtained in the surround-
ing demarcated areas.

In Art 2(2) Commission Regulation (EC) No 607/2009 provides that a
Member State or third country, or the respective authorities thereof, shall not be
an applicant within the meaning of Art 37.

Article 37(2) restricts producers to lodge an application for protection 'only for
wines which they produce'.
