(d) At the request of producers
Article 54(1) provides that the Commission may, at the request of the producers
of product marketed under the registered name, cancel the corresponding
registration.

(e) Examination procedure
Those implementing acts shall be adopted in accordance with the examination
procedure referred to in Art 57(2). Article 57(2) provides that where reference is
made to this paragraph, Art 5 of Regulation (EU) No 182/2011 shall apply.

(f) Opportunity to defend
Article 54(2) provides that in order to ensure legal certainty all parties have the
opportunity to defend their rights and legitimate interests. The Commission
shall be empowered to adopt delegated acts, in accordance with Art 56
complementing the rules regarding the cancellation process.

Article 7(4) of the Draft Delegated Regulation provides that 'reasoned state-
ments of opposition as regards cancellation shall be admissible only if they show
continued commercial reliance by an interested person on the registered name'.

(g) Publicity
Article 7(3) of the Draft Delegated Regulation provides that 'the request for
cancellation shall be made public pursuant to the second paragraph of Art 50(1)
of Regulation (EU) No 1151/2012.'

32. Transitional rules
Article 8 of the Draft Delegated Regulation contains the following transitional
rules:

In respect of protected designations of origin and protected geographical indica-
tions registered prior to 31 March 2006, the Commission shall, at the request of a
Member State, publish a single document submitted by that Member State in the
Official Journal of the European Union . That publication shall be accompanied by the
reference of publication of the product specification.
