empowered to adopt delegated acts, in accordance with Art 56, concerning the
establishment of the methods of production, and other criteria relevant for the
application of the optional quality term established in paragraph 1 of this
Article.
12. Product of island farming
Article 32 provides that no later than 4 January 2014 the Commission shall
present a report to the European Parliament and to the Council on the case for
a new term, 'product of island farming'. The term may only be used to describe
the products intended for human consumption that are listed in Annex I to the
Treaty, the raw materials of which come from islands. In addition, for the term
to be applied to processed products, processing must also take place on islands
in cases where this substantially affects the particular characteristics of the final
product.

That report shall, if necessary, be accompanied by appropriate legislative
proposals to reserve an optional quality term 'product of island farming'.

13. Restrictions on use
Article 33(1) provides that an optional quality term may only be used to
describe products that comply with the corresponding conditions of use.

Article 33(2) provides that the Commission may adopt implementing acts
laying down rules for the use of optional quality terms. Those implementing
acts shall be adopted in accordance with the examination procedure referred to
in Art 57(2).

14. Monitoring
Article 34 requires Member States to undertake checks, based on a risk analysis,
to ensure compliance with the requirements of this Title and, in the event of
breach, shall apply appropriate administrative penalties.
