Many architects finding themselves in this position will wonder where they stand, while
desperately trying to administer the contract and adapt its terms to suit the problems that
half-considered agreements can throw up. Architects should not attempt to rescue the ad-
ministration of a contract which the employer has undermined. If the employer and con-
tractorstrikesomedealthatpreventsthearchitectfromproperlyadministeringthecontract,
itisprobablethattheemployerhasrepudiatedthearchitect'stermsofengagement.Inthese
circumstances, the architect should immediately seek expert advice on his or her position.
If it is repudiation, the architect will be entitled to accept it as such, bringing his or her ob-
ligations to an end and opening the door for a claim for damages against the employer.
