2.4.10 where this clause is stated in the Appendix to apply, the Contractor's
inability for reasons beyond his control and which he could not reasonably
have foreseen at the Base Date to secure such labour as is essential to the
proper carrying out of the Works;
2.4.11 where this clause is stated in the Appendix to apply, the Contractor's
inability for reasons beyond his control and which he could not reasonably
have foreseen at the Base Date to secure such goods or materials as are
essential to the proper carrying out of the Works;
2.4.12 failure of the Employer to give in due time ingress to or egress from the site

wise agreed between the Architect, the Contract Administrator and the

2.4.13 the carrying out by a local authority or statutory undertaker of work in
pursuance of its statutory obligations in relation to the Works, or the failure
to carry out such work;
2.4.14 where clause 2.2 is stated in the Appendix to apply, the deferment of the
employer giving possession of the site under that clause;
2.4.15 by reason of the execution of work for which an Approximate Quantity is
included in the Contract Documents which is not a reasonably accurate
forecast of the quantity of work required;
2.4.16 the use or threat of terrorism and/or the activity of the relevant authorities
in dealing with such use or threat;
2.4.17 compliance or non-compliance by the Employer with clause 5.7.1;
2.4.18 delay arising from a suspension by the Contractor of the performance of his
obligations under this Contract to the Employer pursuant to clause 4.4A;
2.4.19 save as provided for in clauses 2.4.1 to 2.4.18 any impediment, prevention
or default, whether by act or omission, by the Employer or any person for
whom the Employer is responsible except to the extent that it was caused or
contributed to by any default whether by act or omission, of the Contractor
or his servants, agents or sub-contractors.
Further delay or extension of time
2.5
In clauses 2.3, 2.6 and 2.8 any references to delay, notice, extension of time
or certificate include further delay, further notice, further extension of time,
or further certificate as appropriate.
10.2.2 Significant differences
It will be seen that these provisions are essentially a cut down version of
clause 25 in JCT 98, but there are some significant differences which should
be highlighted.
