isnecessarytotakeintoaccountthespeciicationsandanalyticaltechniquesforadditivesassetout
intheCodexAlimentariusasdraftedbytheJointFAO/WHOExpertCommitteeonFoodAdditives
(JECFA).Inparticular,whereappropriate,thespeciicpuritycriteriahavebeenadaptedtorelect
thelimitsforindividualheavymetalsofinteresttotheEFSAinitsscientiicopinionexpressedon
19April2006,whichconcludedthatthecompositionofmaltitolsyrupbasedonanewproduction
methodwillbesimilartotheexistingproductandwillbeinaccordancewiththeexistingspeciica-
tion.ItisthereforenecessarytoamendthedeinitionofE965(ii)maltitolsyrupsetoutinDirective
95/31/ECforE965byincludingthatnewproductionmethod.Maltitolsyrupisamixtureconsisting
ofmainlymaltitolwithsorbitolandhydrogenatedoligosaccharidesandpolysaccharides.Itismanu-
facturedbythecatalytichydrogenationofhighmaltose-contentglucosesyruporbythehydrogena-
tionofitsindividualcomponentsfollowedbyblending.Thearticleofcommerceissuppliedbothas
asyrupandasolidproduct.

TheCouncilDirectiveof29March1996amendsCommissionDirective94/54/ECconcerning
thecompulsoryindicationonthelabelingofcertainfoodstuffsofparticularsotherthanthosepro-
videdforinCouncilDirective79/112/EEC.
Thisdirectiverequiresfoodlabelstoincluderelevantinformationonthesweetenerscontained
infoodstuffs.Italsostipulatesthatwarningsshouldappearonthelabelsoffoodstuffscontaining
ASPorpolyols.
10.2.4.2  Directive 2008/5/EC [OJ L 27 of 31 January 2008]
Other compulsory indications, apart from those provided for in Directive 2000/13/EC, must
beshownonthelabelsofcertainfoodstuffs(forexample,“packagedinaprotectiveatmosphere”
or“withsweeteners”)inordertobetterinformtheconsumer(EuropeanCommission2008a).For
foodstuffs containing ASP, labeling should indicate that it “contains a source of phenylalanine.”
