To sub-contractor, directing that some defects are not to be made good
Dear
The rectification period in the main contract ended on the [ insert date ] and we
have received a schedule of defects from the architect.
Certain of the defects are your liability under clause 2.22 [ substitute '2.16' when
using ICSub/C, ICSub/NAM/C or ICSub/D/C or '14.3' when using GC/Works/SC ]of
the sub-contract and we enclose a schedule of such defects for your attention.
[ Either: ]
The architect has instructed that you are not required to make good any of the
defects shown on the schedule.
[ Or: ]
The architect has instructed that you are not required to make good those
defects marked 'E'.
[ Then: ]
We have been informed that an appropriate deduction will be made from the
main contract sum in respect of defects which are not required to be made
good. You must bear an appropriate proportion of such deduction and it
will be taken into account in the calculation of the final sub-contract sum or
it will be recoverable from you as a debt.
