Thank you for your letter of the [ insert date ].
We are surprised to learn that, in your opinion, practical completion of the
Works/section [ delete as appropriate ] has not been achieved. The items you list
as outstanding can only be described as trivial and they cannot possibly justify
your contention.
We draw your attention to the fact that, under this form of contract, you have
no certifying function and the issue of the practical completion statement is
simply a process of recording a matter of fact. It is not something for your
opinion. We strongly urge you to issue the written statement forthwith as
required by clause 2.27 of the conditions of contract. If we do not receive
your statement by [ insert date ] naming [ insert name ] as the date of practical
completion, we will take whatever steps we deem appropriate to protect our
interests.
The items you list are receiving attention in the normal way.
