Letter 112
To architect, withholding consent to instruction altering the
design of the Works
This letter is only suitable for use with MWD or DB.
Dear
Thank you for your instruction number [ insert number ] dated [ insert date ]
which we received today. Your instruction affects the design of the
contractor's designed portion Works [ substitute 'makes necessary an alteration or
modification in the design of the Works' when using DB ]. Clause 3.4.2 [ substitute
'3.9.1' when using DB ] provides that you may not issue any such instruction
[ substitute 'affect any such change' when using DB ] without our consent.
On this occasion, we regret that we cannot give our consent. Although our
consent is not to be unreasonably withheld, we believe our position to be
reasonable. [ Set out the reasonable reasons for withholding consent. ]
