Letter 93
To employer (not being a local authority), objecting to the
nomination of the employer as replacement architect
This letter is not suitable for use with DB or GC/Works/1 (1998).

Dear
We were surprised to learn that you proposed to act as architect yourself as a
replacement for the previous architect. Presumably, you are purporting to act
under the provisions of clause 3.5.1 [ substitute '3.4.1' when using IC or ICD or
'article 3' when using MW or MWD ]. We are not prepared to accept you acting
in this role. Not only are you not a person registered with the Architects
Registration Board and, therefore, not permitted to use the title 'architect',
we are advised that this kind of provision in a construction contract does not
empower you to appoint yourself as architect and we suggest that you take
your own urgent legal advice to confirm that position.
Unless you inform us by close of business on [ insert a date three working days
from the date of this letter ] that you have reconsidered the nomination, we shall
have no alternative but to seek adjudication on the point and on the damage,
loss and expense caused to us by the breach.
